Due to couples living together, most States now consider just a few days of staying somewhere, to mean Occupancy. Once this happens, there is no way to throw a person out without getting an order from the court. Not being on a lease, or even not paying any rent, does not change this. Any guest who refuses to leave your home on demand is trespassing. You don't have to ';evict'; him/her; call the police to have them removed. RJ
This varies from state to state but in most instances a house guest becomes a tenant believe it or not when they bring belongings into your home that are tangible. These for instance can be furniture have a key etc. Less not forget once they start receiving mail that's the final one. I once tried to remove someone from my home who had only been invited to stay a couple of days and then I was told if the receive mail there I have to go and file eviction papers . So like I said it depends. If you are trying to remove someone just start the eviction process to be on the safe side.
Hard to say. The law will be different in every state and country but in most states the test will be rather vague. Courts will look at such things as whether the person has his own key. Whether he has personal property such as TVs and furniture, or just clothing and toiletries. A person can become a lodger in a day or might still be a guest after a couple weeks. After a month, then he is going to be a lodger in most places unless he is still treated like a guest.
