How to evict a house guest who has become a nightmare. my family owns the house, can she be forced to leave?

this person has stayed with me for about three months, has no job, no car, no friends and she has become a nightmare to have around. She states repeatedly that because she has lived here for more then 30 days that she has the same rights as i do to live here. she has no money, complains about EVERYTHING, destroys things because she cant control her temper..... the list goes on and on. I want this person out,, how do i go about it and whats the quickest way to get her out?How to evict a house guest who has become a nightmare. my family owns the house, can she be forced to leave?
Tell this person it is time to go! Then tell her if she destroys any more property you will file charges against her. Call a lawyer or you local law enforcement to find out the proper and easiest way to evict this person from your house and then escort her out of your life. Make sure you and your family or someone else is present when she leaves and make sure you have possession of any keys she may have. I would then change the locks.





Don't give her 30 days. She is a guest if she does not pay rent. A lot can happen in 30 days---kick her to the curb now. No warning if possible.

There are a lot of states where she DOES have rights. What state do you live in? In a lot of places, if she has gotten mail there, she is a resident. In lot of places she is a common law tenant after a couple of months.
put her stuff out side and change the locks.when shes out.if she doesn't have a receipt for rent then she cant come back in.legally.you call the police.if she makes trouble. don't say she has lived there. say she hasnt lived there.but a few days.yes she has visited. but not actually lived there.she has to have a rent receipt.to be able to stay till you get the court to order her out.put her stuff outside. and change the darn locks, Now.Its Your home not hers.legally she can tear up what she wants to while she is there.you would have to sue her, the police want do anything. i know.you have to be forceful.good luck to you

She has no right to be there whatsoever. If she is over 18 and has not been paying for anything, then the owner of the house has every right to kick her out. However, you did mention that your family owns it and not you. You need to tell the family member who owns the house the problem and have that person kick them out. You can't kick her out if the owner is allowing her to stay there.





Assuming the owner wants her out, they should probably tell her with witnesses and in writing that she has 30 days to get out. If she doesn't comply, then get a lawyer and call the police. If she isn't paying anything and is not legally renting the house, the police can remove her from the property.
Eviction laws are different in many states. I urge you to contact your local Clerk Of Courts and find out what you need to do legally on your part to get her out.

You have to file papers in your local civil court.
Laws are different by state. Look up the tenet rights for your state. There should also be a local number that you can call for advice. In some places, your guest is correct. However, there are ways to get rid of these people. You just need to find out the law and how to do it so she can't come back to haunt you. You may also want to look into taking her to small claims court to recoup the cost of her damaging your stuff. Best of luck.
is there a lease?contract? that says she can stay there, does she pay rent? if not call the police and kick her A** out!
One of the owners of a house that lived with a person like this pretended to tell her tenant that the house was for sale and he had put up a ';for sale'; sign outside. I don't know if that is morally correct, or if you could get into any kind of trouble for that, but this is what he did, and it worked. Good luck!
She has no rights whatever. The next time she goes out, change the locks and put her stuff out on the steps.
Tell her to make an attitude adjustment or get out. And if she doesn't, tell her that you will take legal action if she doesn't. Also, convince her to get a job. The reason she destroys things is probably negative energy that built up. A job would run her down, and calm her down quite a bit.
If you don't have anything in writing you should just call the cops. Just tell them that she was staying there due to your generousity but has overstayed her welcome. If she can't come up with any written proof that she is a legal resident then the cops will tell her to grab her stuff and leave. I ran into the same problem a year and a half ago. My so-called friend threatened to sue me but there was never any written contract so he ended up out on his azz anyways.

Find somebody with a shotgun. When she wakes up have it pointing at her face. Tell her to leave. That might work.





OK REALLY - she has NO rights just because she's been there for 30 days - that means NOTHING. Get your family to help you kick her out. If nothing else you may have to call the police to have her forcibly removed. Good luck.

Hopefully, you had them sign a renter's agreement or lease.


In Alabama, You have to give them an eviction notice first, and then wait like so many days. Then you can get the sheriff involved.


But even then, if they are like elderly or have children living with them, it becomes MUCH harder.





I would probably search your state on the internet for rental evictions or eviction notices. If you have a friend in real estate, they may give you some advice.

If the person has paid any rent, or done services for room and board, then u have to go thru the 'legal' process of serving papers etc....If they are just truly a 'guest' then u can just call the cops and say you want them out......this is of course not legal advice....just from experience ;)
If she's suposed to pay for rent, give her a pay rent or quit form, or a 30 notice to vacate the property.
Charge her rent and when she doesn't pay, you need to legally evict her through the court system. That is what my mother had to do to my brother because it was the only way due to the fact that he had lived with her for so long.
you need to get her officially evicted. she needs to be served with papers. Contact a lawyer.
This person is crazy and can definitely be forced to leave. 30 days means nothing. Call the cops if she won't leave
